Europe is the region with the highest density of institutions for the protection of human rights, with a broad array of domestic, regional and global instruments applicable to the countries in the region spawning a complex normative and institutional architecture. And while the overall record of human rights protection may be better than in other regions, there are many countries in which serious human rights violations persist or in which ostensibly less serious, but still consequential infringements affect large numbers of people. In this seminar, we will review the most important instruments for the protection of human rights in Europe and shine a spotlight on their effectiveness. In addition, we will examine some of the major human rights issues that affect select individual as well a sets of countries and seek to identify the causes of successful as well as unsuccessful interventions to end ongoing violations and provide redress to victims. A special spotlight will be shown on the question of legitimate restrictions of basic rights, such as for reasons of public health.
Lernziel:
The objective of the course is to enable students to analyze institutional (in)effectiveness in the area of human rights by providing them with the factual and theoretical background to assess and explain observable successes and failures of human rights protection in Europe.
Vorgehen:
All principal interaction in the course will take place through MS Teams, a collaboration platform available to all UHH students free of charge (instructions on installation etc. - alas, only in Geman - can be found here: https://www.rrz.uni-hamburg.de/services/kollaboration/microsoft-teams.html, please contact me if you need help in English). In addition, a WhatsApp course group will be used for more immediate communication on seminar and current topics.
For each session there will be a set of assigned readings, guiding questions, and tasks that need to be fulfilled (such as writing brief memos, recording a podcast etc.) to get credit for the course. During the course's original time slot we will explore forms of live discussion using MS Teams and the instructor will be available for questions.
The syllabus has been finalized for the first six sessions; midpoint during the term we will review what tasks and forms of interaction have worked well and which ones need to be changed or improved.
