What do we do, when we create rules and apply them to make decisions? What are rules and decisions? How can and should we create and apply them? These are hard questions not only lawyers, but also psychologists, logicians and philosophers have been trying to find answers to for centuries, if not millennia. In our course we won’t find definite answers to these questions, they are way too big for any one of us to solve. Nonetheless, as lawyers and as human beings we in our professional and daily lives, sometimes unthinkingly, apply countless rules, constantly make decisions and every now and then change an existing rule or create a new one. In this course we will examine what we can and should do to create and apply rules and make good decisions that enable us to get what we want. We will take a closer look at some methods for thinking about rules and decisions.

The course is held in English. It can either be completed as a foreign language course or a seminar, but not both at once. If you attend it as a foreign language course, you may receive a foreign language qualification (‘Fremdsprachennachweis’). If you attend it as a seminar, you can obtain a seminar certificate (‘Seminarschein’).

To complete the course as a foreign language course (English only) you have to attend all course meetings (you can’t miss more than two meetings), write a 2 page working paper (ca. 3500 characters) in English on a subject of your choice within the theme of the course and participate in a 10 minute conversation about your working paper. Your language skills should amount to at least a B2 in the Common European Framework of Reference

(CEFR). A language certificate is not required. Participation is limited to 10 students.

To complete the course as a seminar you will give a 10 minute presentation and write an approximately 20 page essay (ca. 35‘000 characters) on a subject of your choice within the theme of the seminar. While presentations have to be given in English, essays can be written in English, German, French or Italian (and on special request in Spanish). If you want to write an essay in another than your mother tongue you should have a good knowledge of the language you want to write in. Your language skills should amount to at least a B2 or better a C1 in the Common European Framework of Reference (CEFR). A language certificate is not required. Participation is limited to 6 students.

In the first eight weeks up to the 20th of June 2022 I will give an introduction into the field of ‘Legal Reasoning’ and introduce you to the techniques of decision-making, rule-application, analogical reasoning and rule-creation as well as a short introduction to fact-finding and the analysis of evidence. Together we will take a look at and discuss different approaches in the literature so you can get a feeling of what the field is about and have time to choose a subject you would like to find out more about on your own. If we should have time to spare, I will introduce you to the instruments of decisions and rules and some of their features.

Presentations for the seminar essays will be held in the last four weeks starting on 20th of June 2022. Seminar essays have to be written and handed in until 31st of August 2022.

Working papers for the foreign language qualification have to be written and handed in until 20th of June 2022. Conversations will be held after you have handed in your working paper.
