Kommentare/ Inhalte:
Global Constitutionalism seeks to gain a deeper understanding and more sophisticated perspective on the foundations, limitations and principles of political order and their dynamics over time on a global scale. The discipline includes work that refers to constitutionalism as a template for empirical, conceptual or normative research on past, present and future political and legal practices, within and beyond the state.
Global Constitutionalism is not focused on the establishment a global polity organized within a world constitution. Instead the reference to global constitutionalism signifies three things: First, global constitutionalism is interested in highlighting legal and political practices beyond the state, providing a distinct perspective on international relations and international law. Second, it stresses the recognition that with the spread of liberal democratic constitutionalism on the state level after WWII and the end of the Cold War, and the emergence and deepening of transnational governance practices, constitutionalism has provided the basic vocabulary, conceptual resources and ideas that have become the focal point for analyzing, assessing, constructing and contesting legal and political practices both within and beyond the state. Third, reconstructive studies of constitutional dialogues have opened up the field towards including diverse cultural approaches to constitutionalism and democracy from a comparative perspective.

Lernziel:
The study of global constitutionalism is motivated by two observations.
First, an increasing number of cutting edge conference papers and publications note a changing constitutional quality beyond the state including supranational and subnational contexts. The constitutional quality is not derived from domestic constitutions, nor is it derived from a global constitution in any traditional sense. It emerges through practices such as adjudication, cross-referencing, regional integration through law and a growing density of accountability mechanisms in the international arena. That constitutional quality has been identified with reference to patterns of interaction, principles of engagement and practices of regulation.
Secondly, the progressive development of practices and institutions that warrant justice, fairness and democracy on a global scale is intimately connected to progress in our understanding of constitutional terms of reference. Therefore, research on emerging practices and institutions, on the contested principles of justice, legitimacy democracy, the rule of law and on the changing settings of sovereignty and international organization as well as research that focuses more generally on the history of political thought that addresses constitutionalism in ancient, medieval and early modern contexts is required to map progress empirically and elaborate on theoretical conceptions of constitutional quality beyond the state.

Vorgehen:
This seminar will include intensive text work including the preparation of research logs; as well as work group in order to produce presentations on current issues of global constitutionalism in class.

The class is based on the method of problem-based learning which stresses collective and interactive learning, and project related work inside and outside the classroom. Students will be working in small groups, in direct discussion with the professor, or in interactive in-class discussions which include lectures, student presentations, group work, critical discussion and round-table debates. The teaching and learning tools include work with PPTs, audio-video material, the IT and common library research.

Zusätzliche Hinweise zu Prüfungen:
STUDIERENDE mit Studienbeginn AB Wintersemester 2010/11:
Dieses Seminar wird mit einer unbenoteten Studienleistung abgeschlossen (4 ECTS-Leistungspunkte); zusätzlich kann in dem Seminar eine Hausarbeit als Modulabschlussprüfung (weitere 4 ECTS-Leistungspunkte) absolviert werden.

STUDIERENDE mit Studienbeginn VOR dem Wintersemester 2010/11:
Dieses Seminar wird mit einer Hausarbeit (5 ECTS-Leistungspunkte) abgeschlossen. Es gelten reduzierte Prüfungsanforderungen nach Absprache mit dem Dozenten.

STUDIERENDE, die dieses Seminar im Wahlbereich belegen, können dieses ausschließlich in vollem Umfang (Studienleistung und Hausarbeit) mit 8 ECTS-Leistungspunkten abschließen.

Studienleistungen (unbenotet):

For a non-graded mark/(unbenoteten Schein) = Studienleistung
• Students are expected to sign up for a research team. The team engages in a joint project which will be presented in class in two steps: the first step includes presenting the group’s research question and research log, the second step includes presenting the group’s research finding.

Each student is expected to have read the readings marked as ‘required’, command of these readings is necessary for obtaining a ‘pass’ grade; command of the readings listed as ‘additional readings’ will enable students to obtain higher marks; should students be unable to locate readings on the IT or in the library, they should contact the Chair’s office a week prior to the seminar, so that appropriate alternatives can be arranged

Attendance in all seminar sessions is compulsory for obtaining a pass grade (or ‘Schein’); more than two missed sessions will lead failing the class.


Prüfungsleistung (benotet):
For a graded mark/(benoteten Schein) = Prüfungsleistung

1. Having successfully participated in the seminar by reaching at least a passed grade (Studienleistung bestanden)

2. Take Home Exam
2.500 words (ca. 7-8 pp.) Essay, due for pick up from STINE on 05th July 2013 and for submission by 9AM on 8st July 2013
The repeat date will be scheduled on 20th September 2013 and for submission by 9AM on 23rd September 2013
