Environmental law is becoming an increasingly relevant field for regulatory frameworks in international and regional contexts. Within the broadening of public international law and growing relevance of European Union law for realizing the implementation of sustainable development objectives, environmental law holds a key role. Approaching the evolving field of environmental law, this course provides a foundation to the most important principles, instruments, and laws currently shaping the system.
The course begins with an overview of the general principles forming international and European environmental law, the sources and subjects, and the historical origins of the system. The foundational discussion includes key aspects of public international law as well as the relationship between international environmental law with other systems of international law. The second half of the course explores more specific aspects of international and European environmental law, including 1) Pollution/Climate Change, 2) Biodiversity, and 3) Freshwater and Maritime Environmental Law. Students will engage with issues of environmental law on both a theoretical and practical level in the current legal frameworks.
Lernziel:
· Students should acquire a broad understanding of the mechanisms and existing frameworks of international and European environmental law.
· Students should be able to understand the system of rule-making, including compliance and enforcement, and relevant actors in both the international and European contexts.
· Students should understand and be able to critically approach the complexities and limitations of the systems of law protecting the environment.
